Two reports about early retirements at the Federal Supreme Court were denied this Saturday (4/11). Good-natured, but firmly, ministers Eros Grau and Sepúlveda Pertence rejected the possibility of bringing forward the collegiate's withdrawal to the Consultor Jurídica magazine .
The first report reported that Pertence Special Data would leave the judiciary to replace Márcio Thomaz Bastos at the Ministry of Justice. It is nothing new that the dean has always been coveted by the Planalto, nor that he finds it melancholy to say goodbye to the Supreme Court through the conventional liturgy. But the government is not in his plans. His goal is to return to law. “That’s what we know how to do, isn’t it?”, said Belongs to this site, with his peculiar good humor.
Although he says he will leave his position before the deadline, Pertence informs that he intends to unravel a block of relevant cases under his responsibility and to which he feels committed.
Case with the STF
In relation to Eros Grau, the intrigue went further. The minister was attributed with a lack of enthusiasm for his tasks. His flight plan, it was said, would be the delight of his pleasant mansion in the peaceful Tiradentes, the beautiful historic city of Minas Gerais. Of course, the minister does not deny these good moments, but leaving the STF, no way. To friends, he guarantees: if the retirement limit reaches 75 years old (today, compulsory retirement ends careers at 70), he will move on. His deadline, for now, is August 2010. “They're going to have to swallow me,” says the master, laughing.
The alleged lack of enthusiasm Eros disclosed bothered at least two ministers who had access to the rumor. “He is committed to the mission with vigor”, says colleague Gilmar Mendes. For Pertence, Eros Grau has only shown willingness to serve. “His enthusiasm with new legal constructions, such as the effectiveness of the Writ of Injunction, is enviable”, confirms Pertence, referring to the judgment of the case that could result in the application of the private sector worker strike law to public servants.
Eros explains that, if the standard he advocated were in force, the effects of the white strike adopted by flight controllers “could be put down with more vigor”. As for the subliminal attacks he has received in lost spaces in the press, Eros Grau predicts: “If these types of people praised me, it would be a cause for concern”, he concludes.
